This document, our rules, policies and the other documents referenced make
up our Terms and Conditions (“Terms”). The Terms are a legally binding contract
between you and JALUD Embedded s.r.o.. Please read them carefully.
We may amend the Terms at any time by posting a revised version on our
site. The revised version will be effective at the time we post it.

product and use its functionality on the condition that: (a) You are over the age of 18; (b) You only use the product for lawful
purposes; (c) You do not engage in any improper,
indecent or offensive behavior while using the product; and (d) You are not breaking any law in your
relevant jurisdiction by accessing this product.
a customer, you fully agree that the first order of you as a new
customer/distributor will get the device with 90 days’ trial period and 90 days’
payment conditions with money back guarantee. Subsequent orders from the same
customer will have standard 14 days’ payment condition on the invoice.
You understand that the
subscription shall include the following:Maintenance and tuning the quality
of device recognition capabilities in the specific environment given by the
individual customer;Updates of SW
v New sounds (if and when available) General technical support.
Sound event detector shall at all
times retain full legal title and beneficial ownership to the product,
notwithstanding your subscriptions herein. You shall not make reference to, or
otherwise deal with the product in any manner except in conformity with this
terms and conditions.
8.1 Sound event detector warrants
that, subject to the terms and conditions set out herein, the product will be
fit for purpose during the applicable warranty period of 2 years. Our warranty
period will apply with respect to the product purchased from us and before the
expiry of 2 years after the date of purchase.
8.2 Our warranty will not apply:
(a) To products that are not used in
accordance with our instructions, specifications or recommendations.
(b) With respect to defects caused by
pre-existing conditions or technical failures beyond our control.
(c) Products not sold by us.
8.3 Any claim under our Warranty
must be notified to us in writing within 7 days after the discovery of the
alleged defect and must include proof of purchase including date of purchase
and a description of the alleged defect. You must also promptly provide us with
such further information as we may reasonably request from time to time with
respect to your claim.
9.1 By engaging us to provide our
product, you agree to be legally bound by this refund policy. We reserve the
right to change or modify this refund policy at any time.
9.2 We do all we can
to meet your high expectations and provide a product that you will love. Kindly
note that only products ordered through our site will be eligible for a refund
9.3 We allow our customers to get a
refund within a period of 90 days in the event the product is defective and not
as specified upon delivery. You must send an email to us requesting for a refund.
9.4 All refunds will be made to the
debit or credit card on which the original purchase was made.
10.1 You understand that we offer
free of charge customer support during the first 3 months after activation of
the device. Upon the lapse of 3 months of which the device has been in service,
the subscription is optional and will be charged per device when ordered by the
customer. In the event you want to continue with the paid subscription, the
same must be communicated to us at least 14 days before the end of the free
10.2 In addition to clause 10.1,
you acknowledge that support shall only be possible to order only during the
first free 3 months of our trail support period, you will automatically get the
offer with support for the next 2 years and the same will be received during
the second month.
10.3 Kindly note that in the event
you fail to order the support in the course of the first trial period of 3
months, it will be cancelled and it will not be possible to order the same in
the future on the currently purchased device. The order for the support can be
for a minimum period of 2 years i.e. invoices will be set at annual or monthly
intervals, after that the support will be prolonged automatically. You will be
contacted 2 months before the support ends with the new contract for the next 2
years, in the event you do not accept the prolonged period and a new contract,
it will be automatically cancelled.
You agree to indemnify, defend and
hold harmless us harmless from any claim or demand, including reasonable
attorneys’ fees, made by any third-party due to or arising out of your breach
of these Terms and Conditions or the documents they incorporate by reference,
or your violation of any law or the rights of a third-party.
The obligations and liabilities of
the parties incurred prior to the termination date shall survive the
termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either
you or us. You may terminate these Terms and Conditions at any time by
notifying us that you no longer wish to use our service and product, or when
you cease using our site.
13.1 These Terms shall be governed and
construed in accordance with the laws of the Czech Republic without regard to
its conflict of law provisions.
13.2 Our failure to enforce any right or
provision of these Terms will not be considered a waiver of those rights. If
any provision of these Terms is held to be invalid or unenforceable by a court,
the remaining provisions of these Terms will remain in effect.

ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS & CONDITIONS AND AGREE TO BE
BOUND BY THEM.
